Terms of Service

By using Eez4us you agree to the terms described below. If you do not agree, we ask that you stop using the service.

1. What Eez4us is

Eez4us is a platform that coordinates the vehicle-based pickup of minors in school zones. It connects three parties:

• The educational institution (customer): contracts the service and pays the subscription.
• The parent or legal guardian: uses the mobile app to signal they are on their way and to allow their trip to be tracked.
• School staff: see, within the panel, the parents on their way and manually confirm the handover of the minor.

2. Accounts

2.1 School

The school account is created after the commercial agreement is signed. The designated director is responsible for managing the staff with access to the panel and for keeping the student roster up to date.

2.2 Parents

Parents join the platform by school invitation only (there is no open sign-up). The parent is responsible for the accuracy of the data they upload: vehicles, authorized family members and temporary authorizations.

2.3 Credentials

Users are responsible for keeping their password confidential. Any activity under an account is deemed to have been performed by its holder.

3. Commercial model

• Eez4us bills the school monthly based on the number of active students.
• The price per student is agreed in the commercial contract. Parents never pay Eez4us.
• Eez4us is not responsible for financial arrangements between the school and families.
• Non-payment by the school may result in the full suspension of the service for that institution, upon prior notice.

4. Acceptable use

Users agree not to:

• Impersonate another person within the platform.
• Upload false data, especially regarding who is authorized to pick up a minor.
• Use the platform for purposes other than coordinating school pickup.
• Attempt to access, tamper with or extract data belonging to other schools or other families.
• Reverse engineer or circumvent the platform's security measures.

5. Handover of the minor

The system triggers an alert to school staff when a parent enters the geofence of the pickup point. That alert is not proof of handover. The handover of the minor is only confirmed when school staff validate it manually from the admin panel, visually verifying the authorized adult.

Eez4us provides the coordination technology; the decision to release the minor, and the responsibility for doing so, remain with the school.

6. Temporary authorizations

• Parents may generate temporary authorizations with a short code for occasional pickups (a babysitter, a distant relative).
• The code is valid only for the specified date and is invalidated after its first use.
• School staff must visually verify the bearer of the code before releasing the minor.

7. Geolocation

• Tracking is activated only when the parent taps “On my way” and ends when they confirm arrival or cancel the trip.
• It is the parent's responsibility to keep the mobile device on and to grant the requested permissions for the duration of the trip.
• Eez4us is not liable for delays, detours or ETA errors caused by GPS signal, traffic, or the map provider's conditions.

8. Personal data

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these terms.

9. Service availability

We work to keep the platform operational 24/7, but we do not guarantee uninterrupted availability. We may perform scheduled maintenance, giving advance notice whenever possible.

10. Limitation of liability

To the maximum extent permitted by applicable law, Eez4us shall not be liable for indirect, incidental or consequential damages arising from the use of, or inability to use, the platform. Eez4us's total aggregate liability to the school is limited to the amounts actually paid by the school in the twelve (12) months preceding the event.

11. Suspension and termination

• The school may cancel its subscription as agreed in its contract.
• Parents may request the deletion of their account from the app or in writing to support. Their children remain linked to the school unless the school itself removes them.
• Eez4us may suspend accounts that violate these terms or put other users at risk.

12. Changes to these terms

These terms may be updated. We will give reasonable advance notice of significant changes. Continued use of the platform after such notice constitutes acceptance of the new terms.

13. Governing law and jurisdiction

Eez4us operates in several countries. The governing law and the competent jurisdiction are those agreed in the commercial contract signed with each educational institution. In the absence of an express designation in that contract, these terms are governed by the laws of the country where the educational institution is domiciled, and any dispute shall be submitted to the competent courts of that jurisdiction.

Where the consumer protection or data protection laws of the user's country grant rights that cannot be limited by contract, those rights prevail over any provision of these terms that would restrict them.

14. Dispute resolution (users in the United States)

This section applies only to users located in the United States and does not limit the non-waivable rights of users in Mexico or other countries.

• Any dispute between you and Eez4us that is not resolved in good faith shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of in court, except as provided below.
• Class action waiver: disputes are resolved on an individual basis only. You and Eez4us waive class actions, class arbitrations and trial by jury.
• Exceptions: either party may bring eligible claims in small claims court and may seek injunctive relief in court to protect the safety of a minor or against the misuse of data or intellectual property.
• Right to opt out: you may opt out of this arbitration clause by sending written notice to legal@eez4us.com within 30 days of your first acceptance of these terms, stating your name and the associated account. Opting out does not affect the rest of the terms.
• Because the adult accepting these terms does so also in their capacity as parent or legal guardian of the minor linked to the account, this section applies to them in both capacities.
